On November 21, 2018, the Ontario government tabled Bill 47, the Making Ontario Open for Business Act, 2018. The government’s aim with Bill 47 was to repeal many of the amendments made in November 2017 to the Employment Standards Act, 2000 (the “ESA”) and the Labour Relations Act, 1995 (the “LRA”) by Bill 148, the Fair Workplaces, Better Jobs Act, 2017. Bill 148 fundamentally transformed the employer-employee relationship in a number of key areas, while also placing a significant financial burden on organizations already struggling to succeed. With the majority of Bill 148 repealed, the employment law landscape has again changed for Ontario employers.

As such, now is the time to prepare and ensure your organization is ready for the Bill 47 changes—to cease or modify changes that were already in the pipeline, to communicate further changes, or to take credit for maintaining entitlements that are no longer obligatory.
